The Legal Side of This

Presentation to the Springfield R-12 School District
Honorable School Board
Springfield, Missouri
Tuesday November 21, 2006

Presentation Title:

Above are Just some of the profound and tangible evidence currently censored by SPS that  shows Dinosaurs and "Modern" Humans lived on the earth at the same time. LEFT PHOTO: http://www.bible.ca/tracks/tracks.htm A series of 14 human footprints with at least 134 dinosaur tracks in the bed of the Paluxy River, near Glen Rose, Texas. RIGHT PHOTO and following paragraph from http://www.bible.ca/tracks/new-mexico-problematica-track.htm  In 1987 Jerry MacDonald discovered a wide variety of beautifully preserved fossil footprints in the Robledos Mountains of New Mexico. Rumors were heard about "out of place" fossils but the site remained top secret. Finally a tantalizing article appeared in the Smithonian Magazine, July, 1992. The article acknowledged "what paleontologists like to call, 'problematica.'" It described what appeared to be large mammal and bird tracks that, "evolved long after the Permian period, yet these tracks are clearly Permian." With a little detective work and some luck we located the area and even more obvious "problematica." One of several very shallow but almost perfect human tracks found in the mountains of New Mexico in the Permian (supposedly before the dinosaurs).

[Presented in print and audio CD form at the regular Board meeting November 21, 2006.]

Honorable School Board Members, friends and guest. Thank you for your valuable time. I am Swayne Benson Loftis. I live here in Springfield, Missouri. I have six beautiful children in the Springfield R-12 School District. I love those kids!

In this presentation I will explain how my children are being terribly persecuted and harmed by the Springfield School District because they will not deny their faith in Jesus Christ and in the Holy Bible.

The non belief in God, taught in Evolution, has numerous times been deemed by federal courts including the Supreme Court, as a religion. For example: In 1957 in Washington Ethical Society v. District of Columbia [Endnote 1], in 1961 in Torcaso v. Watkins [Endnote 2], and in 2005 in Kaufman v. McCaughtry [Endnote 3] as well as other cases.

The Springfield Public Schools have accepted the blind faith religion of Evolution and teach it as fact and they demand the students from the early grades through high school to blindly accept it as fact also. Since the non belief in God taught in Evolution has been deemed by the US Supreme Court as a religion, the Springfield Public Schools have endorsed a religion.

Since the Springfield Public Schools require all students to accept the blind faith religion of Evolution, I refuse to send my children there. I believe in Jesus Christ and in the Holy Bible and, by the Grace of God, I refuse to let my children be continually coerced and pressured to deny their faith in Jesus Christ and in the Holy Bible. The Bible states that such denying can result in the eternal punishment of their souls by God. Furthermore, I refuse to let my children forfeit honest Science and honest History. The Springfield School District demands I and my children forfeit honest Science and honest History for the sake of propping up their religion of choice, Evolution.

It is against the law for any government entity to force an American to accept a specific religion in order for that citizen to receive basic services such as a K through 12 education.

Therefore, I respectfully request from this Honorable School Board my children’s share of their education funds so they can receive the education they are entitled to under Missouri Law. The prorated amounts for the school year of 2006-2007 to be deposited into my children’s Education Escrow Accounts are outlined with detail in Attachment A.

The State Legislature and Courts have established very stable and productive laws that govern private schools in the Great State of Missouri. [Authors note: There are no state laws governing private school education in the State of Missouri. The only regulations are immunization requirements and fire codes. This is very interesting; with zero "expert" government oversight or standards the private school industry governs itself well and out performs the heavily funded and regulated public schools.]

Our good State Legislature and Courts over a period of decades have determined that the current rules governing private schools create an adequate education for any child that attends and that these schools do not violate civil rights. In short, there is great legal peace in the function and management of private schools in Missouri today. This is a very important note.

When my children’s share of their education dollars are put into my children’s Education Escrow Accounts and then dispersed to the private school of my choice, that is functioning under the current laws of the state of Missouri, make no doubt, anyone that would try to regulate that school differently than it is currently being regulated, is an enemy of equality and freedom.

Remember, the State Legislature and both Federal and State Courts see the education currently given by private schools in Missouri at this time, as adequate. In fact, private school education is generally deemed as one of the most superior educations available. So if anyone wants to change the rules that govern these private schools after they receive the same financial opportunities as the deeply religious public schools, their motivation is one or both of the following: They simply want to steal children’s school money for their own vises, and/or they are motivated by a dogmatic hatred for any religious expression other than their own.

There is one huge dread that most Missouri private schools have. That is, that the government will try to force them to give up the principles of their religious faith if school tax dollars ever reach their school.

Thankfully, the US Supreme Court has cleared the air on this exact subject by ruling on a Cleveland, Ohio school voucher case, Zelman v. Simmons-Harris [End note 4]. On June 27, 2002 in a landmark decision the High Court ruled that school tax dollars can be spent by parents on a religious school for their children’s education without government endorsement coming into play as long as the parents are not coerced by the government to send their children there.

Ironically, since the Springfield Public Schools emphatically embrace the religion of no belief in God in the form of Evolution, if the funds allocated by the Missouri State Legislature for my children’s education are not promptly released to my children’s Education Escrow Accounts to purchase education in a different school that embraces a religion friendly to me and my children, the Springfield R-12 School District will have violated the First Amendment [End note 5] Establishment Clause because they will have only provided funds for schools that teach the blind faith religion of Evolution. To the tune of $6,800 per student per year, they will have preferred one religion over another. This is defended by law in many nations, but not in the United States.

Chapter 3

The Most Accurate History Book in the World: The Holy Bible

What's Taught in the Classroom?

Do the Springfield Public Schools indeed dogmatically teach the children enrolled in their classes that Evolution, not God, is their true father, and that Jesus Christ and the Genesis account of creation are wrong and Evolution is right? And do they harshly ridicule students and teachers that would disagree with them. And has the Springfield Public Schools replaced sound science with bogus Science and even bogus History simply to defend their anti-God religion of Evolution? Let’s take a look.

The following is long, but there is no other way to get to the far reaching details of this presentation with out looking at the details. I apologize for its necessary length. This presentation is about 100 minutes long.

Christians and Jews get their understanding of the origin of life from Genesis, the first book in the Holy Bible. The Jewish prophet, Moses, wrote this book.

The following dates are taken from my own careful observations of Biblical dates and close study of many resources including “Ancient History from Primary Sources, A Literary Timeline” text book by Harvey & Laurie Bluedorn (Copyright 2003, Trivium Pursuit, PMB 168, 429 Lake Park Blvd., Muscatine, Iowa 52716, www.triviumpursuit.com.) I am carefully choosing their date that 3958 B.C. is when the creation of the world occurred.

Moses was born in 1,445 BC. Since this is 2,513 years after the creation of the world, how did Moses know how the Heavens and the Earth and all that is in them were created and about Noah’s flood? The Bible doesn’t exactly say. So what was not taught Moses by historical education and by the education he received from his Jewish ancestors, God, in his sovereignty chose to simply reveal to this great Man of God so all humanity could know the intricate details of how God created the world and life, and consequently, all people could know who they should worship as the Almighty Maker.

So, if indeed, Genesis is true, the world should be jam packed with the evidence of the things God spoke through Moses in the book of Genesis. The Apostles in the New Testament quote early Genesis as accurate and true. It is also important to note that Jesus Christ himself affirmed the absolute accuracy of the early part of the book of Genesis. Jesus did so at least twice in his teachings. I use the New International Version of the Holy Bible in all of my Bible quotes. Jesus said in Mark 10:6-7,

But at the beginning of creation God ‘made them male and female.
‘For this reason a man will leave his father and mother and be united to his wife,

Jesus said in Mathew 24:37-39,

As it was in the days of Noah, so it will be at the coming of the Son of Man.
For in the days before the flood, people were eating and drinking, marrying and giving in marriage, up to the day Noah entered the ark;
and they knew nothing about what would happen until the flood came and took them all away. That is how it will be at the coming of the Son of Man.

The book of Genesis in the Holy Bible is very clear about how life was created. It goes out of its way to illustrate that in six 24 hour days, God created the heavens and the Earth. It was deliberate and quick. Genesis 1:31, 2:1,

God saw all that he had made, and it was very good. And there was evening, and there was morning —the sixth day.
Thus the heavens and the earth were completed in all their vast array.

Every day through the sixth day is noted with, “And there was evening and morning,” with the day number. Genesis says that Adam was created fully developed on the sixth day and Woman was created shortly thereafter from Adam’s rib. [Author's note: Here is a fair question. If the Sun, Moon and Stars were not created until the fourth day (Gen 1:14-19), how was evening and morning being marked as days before the fourth day? Light was created on the first day (Gen 1:3). Apparently on the fourth day, God transferred light from its original source to these new distributors- Sun, Moon and stars. Even new construction sites use temporary power sources (poles and wires) until the permanent power poles and infrastructure are built.]

Does this make scientific sense? Absolutely, yes! With the discovery of DNA, genes and the microscopic processes that make life work, it is mathematically and biologically impossible for these things to have come about on their own [End note 6]. There had to be a very intelligent and deliberate creator. That is precisely what is recorded in the Genesis account of creation. Also remember, it is scientifically impossible for substance to have come from nothing. A force beyond our natural world had to create it. The Bible identifies a force beyond our natural world, God, that simply spoke and substance was created. A true discussion of the origin of life would have to come to terms with this subject of where matter, the elements, came from. Evolution teaching doesn’t take on this question. Why? Because the only scientific answer is that a power beyond our physical world had to create it.

The Bible goes out of its way to illustrate that creation occurred approximately 6,000 years ago showcasing a very young world. Furthermore, the first 1,656 years after creation the Earth was a very different place than it is today. It had never yet rained upon the Earth. Streams came up from the Earth and watered the ground. Genesis 2:5-6,

…for the LORD God had not sent rain on the earth and there was no man to work the ground, but streams came up from the earth and watered the whole surface of the ground— )

Also there was some kind of water shield above the sky that doesn’t exist today and that water shield broke and came to the Earth when the flood occurred. Genesis 1:6-7,

And God said, “Let there be an expanse between the waters to separate water from water.” So God made the expanse and separated the water under the expanse from the water above it. And it was so.

And then in Genesis 7:11-12,

In the six hundredth year of Noah’s life, on the seventeenth day of the second month —on that day all the springs of the great deep burst forth, and the floodgates of the heavens were opened. And rain fell on the earth forty days and forty nights.

Another indication that it did not rain in the pre-flood world is that there were no rainbows in the sky until after Noah’s flood. God’s sign of his covenant to all living creatures on land that he will never destroy the Earth with a flood again. Genesis 9:11-13,

I establish my covenant with you: Never again will all life be cut off by the waters of a flood; never again will there be a flood to destroy the earth.”
And God said, “This is the sign of the covenant I am making between me and you and every living creature with you, a covenant for all generations to come:
I have set my rainbow in the clouds, and it will be the sign of the covenant between me and the earth.

2302 BC is when Noah’s flood occurred, only Noah and his seven family members and all the creatures in the Ark with him were saved. Genesis 7:22,

Everything on dry land that had the breath of life in its nostrils died.

Noah’s Ark came to rest on the Mountains of Ararat which is in today’s eastern Turkey. Genesis 8:3-4,

The water receded steadily from the earth. At the end of the hundred and fifty days the water had gone down,
and on the seventeenth day of the seventh month the ark came to rest on the mountains of Ararat.

People lived to be almost 1,000 years old during that pre-flood world. Genesis 5:27-31,

Altogether, Methuselah lived 969 years, and then he died.
When Lamech had lived 182 years, he had a son.
He named him Noah and said, “He will comfort us in the labor and painful toil of our hands caused by the ground the LORD has cursed.
After Noah was born, Lamech lived 595 years and had other sons and daughters.
Altogether, Lamech lived 777 years, and then he died.

[Author's note: Some will poke fun at the thought of humans living almost a thousand years early in the history of the Earth. But we have fossil evidence that life was filled with phenomena early on. For example, can you imagine animals walking on the face of the earth that are over 115 feet in length, or sharks three times larger than today’s great white sharks'? We have fossils that prove these fairy tale like phenomena existed. In light of these facts, phenomenal life spans for early humans are well within scientific reason.]

Noah had the opportunity to talk to his father, Lamech. Lamech was 56 years old before Adam, the first man, died. So Noah’s father had the opportunity to be an eye witness of Adam, making him able to relate first hand witness to Noah.

Noah lived 350 years after the flood or until 1952 B.C. Genesis 9:28,

After the flood Noah lived 350 years.

Now Abram, who was later named by God, Abraham, is the father of the Israeli nation. Abram, or Abraham, was born about 1950 B.C. That’s 2 years after Noah died. So Abraham’s father, Terah, had about 70 years to personally meet and talk to Noah himself. Then Terah had the opportunity to relate that eyewitness encounter to his son, Abraham.

Now, Noah’s son Shem, who was an eye witness of the Flood and road on the Ark, lived until 1900 B.C. Abraham was 50 years old when Shem died, so Abraham could well have not just know of Shem, but personally met and talked to him. Tracing back to the beginning of time is not quite so mysterious when you take these facts into consideration.

Back to Abraham, born in 1950 B.C. Abraham is also the father of Ishmael who is the father of the Islamic nations today. Genesis 16:15,

So Hagar bore Abram a son, and Abram gave the name Ishmael to the son she had borne.

Abraham is also the father of Isaac. Genesis 21:5,

Abraham was a hundred years old when his son Isaac was born to him.

Isaac is the father of Jacob who an angel of God later named Israel. And Israel’s decedents are the Jews.

In 1766 BC during a famine, the man, Jacob (or Israel), and his family of 70 moved to Egypt. Eventually they found themselves as slaves to the Egyptians, building their cities. Exodus 1:11.

So they put slave masters over them to oppress them with forced labor, and they built Pithom and Rameses as store cities for Pharaoh.

Israel Delivered from Egypt

And then in 1445 B.C. God raised up a prophet named, Moses. God sent many plagues on Pharaoh and Egypt until Pharaoh ordered the Jews to be gone from Egypt. The Jews still celebrate the Passover that commemorates that night of miraculous deliverance. In 1445 B.C. at the age of 80, Moses led the Israelis out of Egypt. For the next 40 years, God did miracles on a daily basis as He sustained His people, the Israelis, in the Sinai Peninsula near the Red Sea. Six days a week God sent a bread like substance, called manna from the sky to feed His people. Exodus 16:32,

Moses said, “This is what the LORD has commanded: ‘Take an omer of manna and keep it for the generations to come, so they can see the bread I gave you to eat in the desert when I brought you out of Egypt.’ ”

A cloud by day and a fire by night protected and guided them. It was during this historic time of God’s daily interaction with them that Moses, from knowledge of history and from divine understanding given to him by God, he, in about 1445 BC wrote the first five books in the Holy Bible, including the Creation account, Noah’s flood, and the Ten Commandments. [Author's note: God actually spoke the Ten Commandments out loud for all Israel to hear and then wrote them with his finger twice on tablets of stone for Moses and Israel. Deut 4:12-13 "Then the LORD spoke to you out of the fire. You heard the sound of words but saw no form; there was only a voice. He declared to you his covenant, the Ten Commandments, which he commanded you to follow and then wrote them on two stone tablets."]

The Holy Bible gives a complete genealogy from Adam to Joseph, the step father of Jesus Christ. The Bible says there were 69 to 84 generations from Adam to Jesus Christ. (The difference is between Mathew 1:1-17 and Luke 3:23-38 as each give a different linage of Joseph, the step-father of Jesus, to King David. They follow the same linage from King David back to Abraham. The difference shows some kind of human error, but no foundational doctrine discrepancy.)

                      84 generations

The Bible is very, very clear that there are not tens of thousands, or millions or even billions of years from the creation of life to Jesus Christ. Only 84 generations max. The ages of men combined with details of kingdoms and events through history add up to show approximately 3958 years from the first week of Creation to Jesus Christ. Add that to 2006 years since Jesus Christ was born and you get 5,964 years. About 6,000 years since creation.
